Shebeshxt’s legal battle deepens with 11 new charges

Popular Limpopo musician Lehlogonolo “Shebeshxt” Chauke appeared in the Polokwane Regional Court, where his legal team challenged 11 additional charges brought against him.

The defence argued that the charges should be dismissed, maintaining that the matters had already been finalised in the Seshego and Lebowakgomo Magistrates’ Courts.

Charges include robbery and firearm-related offences

The additional charges include robbery with aggravating circumstances, assault with intent to cause grievous bodily harm, as well as several firearm and ammunition-related offences. Making it a total of 20 charges.

According to the defence, prosecuting Shebeshxt on these counts would violate the legal principle of double jeopardy, which prevents an individual from being tried twice for the same offence after a matter has already been concluded.

Defence invokes double jeopardy

During proceedings, Shebeshxt’s lawyers submitted that the charges stem from matters they believe were previously dealt with by other courts.

They asked the Regional Court to dismiss the 11 counts, arguing that allowing the prosecution to proceed would amount to retrying the artist for offences that have already been finalised.

Court to determine next steps

The prosecution is expected to oppose the application, after which the court will decide whether the principle of double jeopardy applies in this case.

The court’s ruling will determine whether the 11 charges remain part of the proceedings or are struck from the indictment.

Case continues

The matter remains before the Polokwane Regional Court, with proceedings set to continue once the court has considered arguments from both the defence and the State.

A decision on the defence’s application could significantly influence the direction of the case as it moves forward.
