Kaizer Chiefs are set to face the Premier Soccer League (PSL) Disciplinary Committee for two separate cases, prosecutor Zola Majavu has confirmed.
Chiefs have faced an ongoing legal saga since their Covid-19 outbreak at the Naturena Village which prevented them from honouring two league fixtures against Golden Arrows and Cape Town City in December.
The PSL initially denied their requests to postpone the game, to which Chiefs took the matter to arbitration at SAFA, where they won the case and saw their two league fixtures, replayed – both which were lost last month.
However, they have landed in hot water for their first game when returning to domestic action for naming to DStv Diski Challenge players on the bench in the 2-0 win over Sekhukhune United at FNB Stadium.
“Kaizer Chiefs football club will be appearing before the PSL DC tomorrow, 13 May, to answer on charges of fielding defaulters Aiden McCarthy and Mduduzi Shabalala in a fixture between themselves and Sekhukhune.”
Majavu went on to confirm that despite replaying the fixtures and after the High Court ruling, Amakhosi will still face the music in front of the PSL DC, one week after their scheduled appearances over the DDC players who were allegedly not registered in the DStv Premiership.
“Chiefs will also be appearing in front of the PSL DC on 17 May 2022 at 16h00, this is a continuation of the matter that was previously on the roll, which I withdrew after the arbitrators’ award under the advocate Nassir Cassim as he had found, Chiefs were justified for not fulfilling those fixtures with specific reference to the Covid situation,” he continued.
“The PSL committee elected to challenge that outcome and took it on review in the result I decided not to proceed further with that particular case but rather to await that outcome of the review in the high court.
“I can now confirm that the review in the High Court was finalised on 10 May 2022 – I can confirm the award of Advocate Cassim was reviewed and set aside and replaced with an order to the effect that the PSL football department manager decision and subsequently confirmed by the executive committee decision of the league, have been confirmed and in the result, the referral to arbitration was equally set aside.
“That being the case, I have decided to proceed with the case, that was placed in aviance in terms of which Kaizer Chiefs must still come before the DC and account for their non-fulfilment of those fixtures.
“Those fixtures were rescheduled and subsequently played by Kaizer Chiefs and the affected clubs – however, the outcome thereof has absolutely nothing to do with the fact that misconduct was committed and it remains up to the PSL DC whether or not the league would have proved its case on allegations of misconduct.”
