The Special Tribunal has set aside South African Airways’ decision to extend an R85.34 million aircraft lease with Flyfofa Airways.
The Tribunal found that SAA’s board extended the dry-lease agreement for a Boeing 737-300 freighter for another 36 months without a procurement process and without National Treasury approval for a deviation.
The court found the decision inconsistent with the constitutional requirement that public procurement be fair, equitable, transparent, competitive and cost-effective.
The Tribunal has ordered Flyfofa to provide the SIU with a detailed account of the money it received and the costs actually incurred under the extension.
Any profit or unjustified enrichment identified must be repaid, with interest.
The judgment also directs that the matter be sent to the responsible minister and SAA leadership for consideration of possible action involving people who served on the board when the extension was approved.
