Former South African president Jacob Zuma told the Western Cape High Court that while the Umkhonto weSizwe (MK) party does have a constitution, it is currently suspended.
His statement is part of his response to a case where 10 expelled MK MPs, led by Thami Khuzwayo, have challenged their dismissal.
Advocate Dali Mpofu represents the MK party, while attorney Wendy Cele represents the expelled MPs.
The case is set to return to court on Tuesday.
Zuma disagreed with the expelled MPs’ claim that the party lacks a constitution and cannot legally expel them.
He explained that the party submitted its constitution to the Independent Electoral Commission (IEC) when it was registered, as required by law.
“In February 2024, the party decided to operate via the interim leadership council, effectively suspending its constitution. This decision was communicated to and accepted by the IEC,” Zuma wrote in his court papers.
The fired MPs claim that they left their jobs to serve as MPs and are now without income or support for their families.
Zuma argued that the MPs had not provided specific evidence to support their claims.
