Grammy Award-winning producer and composer Lebo M says he is preparing to institute a counter-claim of R100 million lawsuit against his former business associate, Sibongakonke “Sibu” Mhlungu, significantly escalating the legal battle between the two of them.

The internationally acclaimed producer, whose real name is Lebohang Morake, revealed this in a strongly worded response on Thursday after Africa Daily published a story in which it stated that Mhlungu is suing him for R5 million for defamation and loss of sponsorship after he ( Lebo M) “falsely” accused him of stealing R10 million from him.

According to Lebo M, his concern extends beyond the legal action itself to the manner in which the summons was allegedly distributed before being formally served through the prescribed legal channels.

In a statement released by his spokesperson Simphiwe Majola, Lebo M said court documents are required to be served through authorised legal processes, including by the Sheriff of the Court, and questioned the public dissemination of the summons before lawful service had taken place.

Majola said Lebo M’s legal representatives are currently reviewing both the institution of the proceedings and the circumstances surrounding the circulation of the documents.

He added that Lebo M reserves all his rights in law, including challenging any procedural irregularities, opposing any abuse of process and seeking appropriate legal relief where necessary.

The dispute comes against the backdrop of an ongoing financial reconciliation and audit process linked to the parties’ previous business relationship.

According to Lebo M’s representatives, that process has remained unresolved for nearly a year amid what they describe as serious unanswered financial questions and disputed accounting matters involving substantial sums entrusted to Mhlungu and entities associated with him.

The producer maintains that accountability, transparency and proper financial reconciliation cannot be replaced by public disputes, media sensationalism or litigation-driven intimidation.

Following consultations with his legal team, Lebo M confirmed that he intends to vigorously defend the defamation action while simultaneously preparing a counterclaim currently valued at R100 million.

The counterclaim stems from alleged reputational, commercial and international damages suffered over an extended period.

“As a globally recognised creative and business figure, Mr Morake has spent decades building a legacy rooted in artistic excellence, cultural diplomacy and African storytelling at the highest level,” said Majola.

“Any attempt to weaponise public perception, media narratives or legal processes in a manner that undermines that legacy will be addressed decisively and through the appropriate legal channels.”

Lebo M also said he plans to participate in a series of international media engagements aimed at responding to allegations and narratives circulating in local and international media.

According to Majola, the purpose of the interviews is not to litigate matters through the media but to ensure that his perspective and the broader context surrounding the disputes are equally represented in public discourse.

Lebo M said he remains committed to allowing the legal process to unfold while taking all lawful steps necessary to protect his reputation and legacy.
