Should South Africa’s Sex Offender Register Be Public?

A campaign publicly identifying convicted sex offenders has renewed debate over whether ordinary South Africans should have greater access to the National Register for Sex Offenders (NRSO).

According to the Cape Argus, Parliament’s Portfolio Committee on Police chairperson Ian Cameron plans to publish the photograph, name, verified conviction and sentence of at least one adult convicted sex offender every day for 30 days.

The publication reported that Cameron intends to use information from public court records rather than the confidential NRSO.

What is the National Register for Sex Offenders?

As outlined by the Cape Argus, the NRSO contains information on people convicted of certain sexual offences. It is intended to prevent offenders from being placed in positions where they could have access to children and other vulnerable people.

However, ordinary members of the public cannot currently search the register.

The Cape Argus reported that schools, crèches, hospitals, employers and organisations working with vulnerable people can apply to determine whether a person is listed. Parents, however, cannot directly search the database themselves.

According to the report, the Justice Department said existing legislation keeps information on the register confidential and would need to be amended before wider public access could be introduced.

Justice and Constitutional Development Minister Mmamoloko Kubayi has instructed officials to consider possible amendments, the Cape Argus reported.

Calls for controlled public access

Speaking to the Cape Argus, Cameron argued that greater access should not expose offenders’ home addresses, identity numbers or information that could identify victims.

Dr Shaheda Omar from the Teddy Bear Clinic also told the publication that she supported carefully controlled access but warned against turning the register into a tool for public punishment.

Omar stressed that a register cannot guarantee a child’s safety because it only contains people whose cases resulted in convictions, according to the report.

The Cape Argus also quoted Ilitha Labantu spokesperson Siya Monakali, who backed wider access while calling for accurate and regularly updated information.

Monakali warned that any system would need a way to correct records if convictions were overturned or a person’s legal status changed.

Register alone will not solve the problem

According to the Cape Argus, Cameron, Omar and Monakali agreed that opening the register would not solve broader weaknesses in the criminal justice system.

The report highlighted the continued importance of effective investigations, forensic services, proper vetting and stronger child-protection measures.

The debate now centres on whether South Africans should receive greater access to verified information while still protecting victims and preventing harassment or vigilantism.
