The South African Police Service has dismissed Crime Intelligence deputy head Major General Feroz Khan after he failed to appear for an expeditious disciplinary process.
SAPS spokesperson Brigadier Athlenda Mathe confirmed on 2 September that Khan was “deemed dismissed” under Regulation 9(7)(b) of the SAPS Discipline Regulations.
The Labour Court had previously rejected Khan’s urgent bid to stop the disciplinary process.
Mathe said SAPS remained committed to accountability, discipline and professional conduct, adding that no member was above the law or the disciplinary framework.
Criminal case remains before court
Khan also faces a criminal case in the Kempton Park Magistrates’ Court.
He was arrested in May alongside Gauteng Hawks head Major General Ebrahim Kadwa and businessman Tariq Downes over allegations linked to the unlawful possession of precious metals and defeating the ends of justice.
The case stems from a May 2021 incident at OR Tambo International Airport, where Downes was allegedly found with 75.9 grams of unwrought gold.
Prosecutors allege Khan and Kadwa intervened to secure Downes’ release despite no authorised undercover operation being in place.
The three accused were granted R20,000 bail.
Madlanga allegations remain untested
Khan has also featured extensively in evidence before the Madlanga Commission.
Witnesses have accused him of interfering in the investigation into a 2021 Aeroton cocaine seizure.
Evidence leaders have also presented WhatsApp messages and other material allegedly linking him to tender dealings involving tobacco businessman Mohamed “Mo” Sayed.
Further allegations concern his links to EFF leader Julius Malema, Khan’s finances and an assault complaint involving former Investigating Directorate Against Corruption head Andrea Johnson.
The commission has stressed that the allegations remain untested because Khan has not yet testified.
Medical certificates also scrutinised
Khan’s medical certificates have also come under scrutiny at the commission.
Evidence leader Adila Hassim raised concerns about dates on the documents, while Khan’s doctor reportedly said his son had requested changes that resulted in backdated notes.
Khan was shot and wounded in Johannesburg in June, shortly before he was due to testify.
SAPS said it would continue respecting court decisions and provide further information about the dismissal where legally permissible.
