The MK party has twice lost its attempts to include its deputy president John Hlophe in the Judicial Service Commission (JSC) panel interviewing future judges.
First, the Western Cape High Court barred Hlophe from the 7 October JSC session. Then, the JSC rejected the MK party’s postponement request.
The party plans to go to court to stop next week’s sitting. If that fails, MP Mzanele Manji said they would protest at the JSC hearing.
Hlophe, former Western Cape High Court judge president, was impeached earlier this year. In 2008, he was accused of trying to influence judges in a Constitutional Court case involving Jacob Zuma.
The JSC decided on Monday to proceed without Hlophe, following the high court’s interim decision.
The court didn’t remove Hlophe from the six-MP delegation representing parliament at the JSC.
“While the full court has interdicted Dr Hlophe (on an interim basis) from participating in the processes of the JSC, it expressly found that Dr Hlophe’s absence would not render the JSC’s decisions or process unlawful,” the commission said.
