Judgement on hold in case of MPs challenging expulsion from MK

Judgment in the case of the 10 MPs who are challenging their recall by the Umkhonto Wesizwe (MK) party has been reserved by the Western Cape High Court.

A last-minute attempt to have the matter resolved out of court failed.

The legal team for the MPs spent their entire slot attacking an affidavit that was filed by former president Jacob Zuma in his capacity as the founder and leader of the party.

Among the matters they addressed with the court was jurisdiction, after Zuma claimed that the decision had been made in Nkandla in KZN and that the matter should be heard there.

The legal team of the applicants argued that the Western Cape High Court is the right court since the matter affects MPs who are in Parliament in Cape Town.

They also argued that Zuma was being economical with the truth when he said the MPs, led by Thami Khuzwayo, had never had MK party membership. They argued that the applicants were members of the party before they were expelled.

The legal team of the MK Party argued that the expulsions were correctly carried out and the MPs were trying to score undue benefits by asking the court to set aside their removal.

At some point after the arguments, there was a short break where all parties tried to reach an out-of-court settlement, but no agreement was reached and the matter continued. Judgment is expected between tomorrow and Friday this week.
