Dali Mpofu’s tenure as Advocates for Transformation’s (ATF) representative on the Judicial Service Committee (JSC) has come to an end, according to the national chairperson in a statement issued on Sunday.
The ATF’s chairperson, Myron Dewrance, stated that the body was aware that Mpofu’s term as a representative had expired on February 10th. At its AGM in Bloemfontein in June 2017, AFT announced that its candidate would serve on the JSC for a two-year term through the General Council of the Bar, with a maximum of two terms.
Mpofu was elected to the JSC for a one-year term that year and was re-elected at a later AGM in 2019. “AFT is presently engaged in a process to identify a suitable successor, and the Commission will be advised in due course of the successor,” Dewrance said.
Mpofu responded last week to President Cyril Raamphosa’s claim that the JSC exceeded its mandate by recommending Supreme Court of Appeal President Mandisa Maya as South Africa’s next chief justice.
On Thursday, Acting Chief Justice Raymond Zondo was appointed to the top judicial position, with duties beginning on April 1. Despite the JSC’s recommendation in February that Maya takes over the job, this has not happened.
Mpofu said on Friday that Ramaphosa’s remarks that the JSC went above and beyond its remit by recommending Judge Maya when three other judges had been nominated for the position were incorrect.
“That view has also been bandied about by various other people [and] it’s an incorrect view, it’s just a wrong view,” Mpofu said in an interview with Newzroom Afrika, in his capacity as one of the spokespersons for the JSC.
