Court declares Mosiuoa Lekota of ‘unsound mind’ as partner empties accounts

  • During this period of incapacity, Lekota’s partner allegedly emptied his bank accounts, transferring R400,000 to her own interests.
  • The court ordered the partner to pay legal costs after failing to provide a credible explanation for the suspicious withdrawals.

The Gauteng High Court in Pretoria has delivered a significant judgment regarding the final months of the late Congress of the People (COPE) leader, Mosiuoa “Terror” Lekota.

The court found that from 25 May 2025 until his passing on 4 March 2026, Lekota was of unsound mind and lacked the legal capacity to oversee his personal and financial affairs.

This ruling follows a legal challenge initiated by his wife, Cynthia Lekota, who originally petitioned the court to appoint a legal representative to gain access to her husband’s medical records.

The subsequent investigation revealed that during Lekota’s period of incapacity, his “partner” had systematically drained his current account.

According to the judgment dated 23 March 2026, over R400,000 was moved from Lekota’s account just as legal proceedings were beginning.

Specifically, R250,000 was transferred to the partner’s solicitors, while a further R150,000 was sent to her property company. The court noted that these transactions, completed on 12 February 2026, remained entirely unexplained by the respondent.

Consequently, the court officially declared Lekota’s state of mind as unsound during the period in question and ordered the partner to pay the legal costs of the application. The findings highlight a troubling breach of fiduciary responsibility during the veteran politician’s final days.
