Advocate Busisiwe Mkhwebane, the Public Protector, will file a criminal complaint against Ismail Abramjee at the Brooklyn Police Station in Pretoria today.
Abramjee, according to reports, sent a text message. The text message resulted in the last-minute postponement of an urgent application in the Western Cape High Court to prevent President Cyril Ramaphosa from suspending Mkhwebane on April 26, 2022.
Abramjee allegedly sent the text message to the Speaker of the National Assembly’s lead senior counsel and the Chairperson of the Section 194 Committee.

“This suggested that the apex court’s decision was leaked to Abramjee before it could be made public.
“The decision in question has a profound bearing on the proceedings before the Western Cape High Court. The leaking of such sensitive information, if established, will also have a huge bearing on the rule of law and the independence of the judiciary.”
Dali Mpofu SC, Mkhebane’s counsel, stated that the parties agreed to postpone it. He explained that this was done to ‘seek clarity’ over the ‘unfortunate development.’ This is reportedly related to the Public Protector’s application to the ConCourt to vacate a judgment. The decision paves the way for Parliament to continue its impeachment proceedings against her.
Mkhwebane petitioned the ConCourt to overturn or rescind the judgment. She stated that it contains patent infringements. However, the ConCourt has not issued a decision or issued any directions in the application.
In the meantime, Mkhwebane went to the High Court in Cape Town. She asked for an interim interdict to prevent Parliament from proceeding until the ConCourt made a decision.
