Polokwane High Court Dismisses Peter Gagash Nonyane, Charlotte Tibane Bail Appeal
The Polokwane High Court has dismissed Peter Nonyane and his wife, Charlotte Tibane’s, bail appeal, with Judge Pillay upholding the decision to keep them in custody.
In her ruling, Judge Pillay said the State had demonstrated sufficient grounds to oppose their release, including the risk of witness interference and the seriousness of the allegations involving the alleged misappropriation of funds from deceased estates.
The judge rejected the appellants’ arguments that the State’s case was weak and that the evidence did not sufficiently establish intimidation or interference with witnesses. She said the court had to consider the totality of the circumstances, including the strength of the State’s case, the ongoing investigations and the risks associated with releasing the accused.
The State alleges that approximately R6 million was involved in theft and money laundering linked to deceased estates.
Nonyane and Tibane remain in custody and are expected to appear in court again on 6 November 2026.
