PSL prosecutor Zola Majavu has confirmed that Golden Arrows have exercised their appeal rights after the DC found them guilty of fielding an ineligible player.
Arrows were found guilty by the PSL DC in the case involving Simo Mbhele, as confirmed again earlier this week, and while many had predicted points could be docked, were only given a monetary fine.
However Arrows have still decided they are not pleased with the outcome, and Majavu says it is their right to appeal.
“I can confirm that earlier this afternoon,” Majavu said
“Lamontville Golden Arrows Football Club, as they are entitled to do so, decided to exercise the appeal rights by challenging an earlier decision of the PSL DC in terms of which they were duly found guilty for having fielded an improperly registered pleasure, Mr. Simo Mbhele and on the basis that when he’s registration was procured by the league registrations department that was done so in the absence of an unambiguous requirement of an international clearance certificate, ITC for short.
“Having led all the evidence, the disciplinary committee of the league returned a verdict of guilty and sanction was reserved when sanction ruling came out a few days ago, the PSL DC sanctioned Lamontville Golden Arrows with a reprimand plus an order to pay the costs of the two disciplinary hearing sittings.
“Now, the club, as well as the player, seem to be aggrieved by that decision, which is the reason for the notice of appeal which the league received earlier. I can indicate that at this stage, I have not definitively made a decision with regard to what the stance the prosecutor would take.
“However, I do not rule out the possibility of filing a cross appeal against Lamontville Golden Arrows with regard to the sanction which was in any event emitted by the disciplinary committee.
“It is a decision that I will make in the fullness of time. All that suffices for now is to put it out there that Golden Arrows together with Mr Mbhele have exercised their right to challenge the DC decision insofar as they were found guilty.
“We need not preempted outcome there off, I will deal with the submissions and the grounds of appeal at the appropriate forum, if and when we get to that stage.”
