BCM Stars have won their appeal at the ruling of the SA Spear of the Nation made by the Eastern Cape Disciplinary Committee (ECDC) almost two weeks ago.
The ECDC had handed down its judgment on an abandoned first leg of the provincial playoff tie, with the verdict’s outcome ruling in favour of Spears, who were awarded three points after BCM were found guilty of the ugly scenes at Issac Wolfson Stadium last month.
However, in a turn of events, BCM pursued an appeal against the ruling, citing that they would “not surrender into injustice”.
Last Friday, the matter was heard at the Safa House, presided by Advocate Nazeem JC. The Gqeberha-based outfit has now won the arbitration, and the game will be replayed in a neutral venue which the Safa will decide.
ARBITRATION’S OUTCOME
1. The appeal is upheld.
2. That the order of the Disciplinary Committee of 21 April is set aside and replaced with the following:
a) That the match between BCM Stars and SA Spear of the Nation be replayed at a neutral venue to be decided by Safa behind closed doors (no spectators).
b) That BCM be ordered to pay a fine of R20 000 before the replay of the above-mentioned match.
c) That BCM pays the travelling and accommodation costs incurred by Safa before the replay of the above-mentioned match.
d) That BCM Stars pay the legal cost on a party and party scale, which costs include the cost of the Arbitrator before the replay of the above-mentioned match.
