The ANC has been granted permission by the Durban High Court to appeal the April ruling that allows the MK to use the uMkhonto Wesizwe name and its current logo.
The case will now go to the Supreme Court of Appeal (SCA) in Bloemfontein, with the date yet to be set.
Last week, the ANC’s lawyer, Advocate Gavin Marriot, argued that the MK Party’s use of the logo could confuse voters and cause problems during elections and other events.
He asked Judge Chetty to let them take the case to the SCA, suggesting another court might rule differently.
MK’s lawyer, Advocate Dali Mpofu SC, disagreed. He said the ANC was trying to reargue the case they lost in April.
“Leave to appeal against the whole of the order and judgement of the court is granted to the Supreme Court of Appeal,” reads part of the ruling on Thursday.
