SIU Welcomes Tribunal Ruling Dismissing Mabe Bid To Halt Recovery Case
The Special Investigating Unit has welcomed a Special Tribunal judgment dismissing Puleng Peter Mabe’s bid to suspend civil recovery proceedings against him and Enviro Mobi (Pty) Ltd. Mabe was also ordered to pay the costs of the application.
Mabe wanted the case paused until a High Court review and his criminal trial were finalised, arguing that the SIU’s pre-proclamation inquiry and forensic findings were unlawful.
The tribunal rejected his arguments, ruling that the preliminary inquiry was lawful, Presidential Proclamation No. R15 of 2021 was valid, and the review had poor prospects of success. It also found that criminal and civil proceedings can run concurrently.
The case involves a R27.6 million Gauteng government tender awarded to Enviro Mobi for 200 motorised waste-collection vehicles. The City of Ekurhuleni later bought another 70 vehicles for about R9 million.
The SIU alleges that more than 90% of the money paid to Enviro Mobi was transferred to accounts controlled by Mabe and that the tender was irregular, resulting in losses of more than R25 million.
A preservation order freezing a Steyn City property and a Porsche 911 Carrera GTS remains in place. Mabe and his co-accused face charges including fraud, theft and money laundering and remain out on bail.
The SIU says it will continue with the civil recovery case and cooperate with the NPA.
