The decision follows a review that found no reasonable prospect of a successful prosecution. Prosecutors must still return to court to formally withdraw the case.
The National Prosecuting Authority has instructed prosecutors to withdraw the Public Finance Management Act charges against national police commissioner General Fannie Masemola.
In a statement issued on Tuesday, 15 September 2026, the NPA said National Director of Public Prosecutions Advocate Andy Mothibi reached the decision after reviewing evidence gathered by the Investigating Directorate Against Corruption, a Case Assessment Panel report and an independent senior counselβs assessment.
Mothibi found that there were βno reasonable prospects of a successful prosecutionβ against Masemola on the PFMA charges, the NPA said.
βEnrolling a case for prosecution where evidence is not sufficient to sustain a successful prosecution is not in the public interest,β Mothibi said.
The NPA said the prosecution team would arrange for Masemola to appear in court so the case could be formally withdrawn. It has not announced a court date. Until that appearance, the withdrawal remains an instruction to prosecutors rather than a completed court proceeding.
The NDPP also intends to refer the matter to the IDAC Judge for an examination of how the prosecution team assessed the evidence, enrolled the case and applied the law. The purpose is to determine whether there was any misconduct. The NPA has not said that misconduct has been established.
According to the statement, Masemolaβs lawyers submitted representations, but these did not change the outcome: Mothibi had already decided to withdraw the charges following the evidence review.
The NPA said its review of other IDAC cases would continue under its reset programme.
